October 28, 2008 To all idBUSINESS Subscribers and Business Owners affected by the Red Flag Rules, You may have heard about the Federal Trade Commission's decision to delay enforcement of the Red Flag Rules from November 1st until May 1st. The FTC made this decision in light of several factors. First, groups of businesses like physicians who had never previously been subject to FTC jurisdiction were unaware of the Rule and its applicability to them. Second, economic turmoil limited the level of attention that could be granted to compliance by the financial sector. Now, this news may be upsetting to you. After all, you were the early adopter - the responsible business owner who found a solution before November 1st. Many of you have even already become 100% compliant. Please be assured that your hard work is worth it - today - for three key reasons: While the FTC is delaying their enforcement of the Red Flag Rules until May 1st, their decision does not alter the law, which still says that all covered entities must be compliant by November 1st. As a result, if a noncompliant company has a breach on January 15th, the ensuing class action lawsuit from their customers can still show that business as negligent under the law. All the FTC ruling means is that you will not be punished by FTC fines for a breach during this period. The FTC is granting this extension not only to give companies more time, but to give the FTC itself more time, for a concerted public outreach and information campaign about the Red Flag Rules, and about business' responsibility to protect customer data. This means that the low awareness of the Red Flag Rules will not last for long. Your customers may begin asking you what policy you have in place. idBUSINESS plans to support you with this program. In the weeks to come, we will provide our compliant customers with a button for your web site, that will link to a description of your Red Flag policy, allowing your customers to know that their data is safe with you. Some have challenged the wording of the Red Flag legislation, and wondered if enforcement would have "teeth." The postponement points to the fact that the FTC plans to vigorously enforce the Red Flag Rules. On May 2nd, noncompliant companies will be in violation in spite of being given well over a year to comply from the date of the law's passage (1/1/08). With this in mind, the fact that you have already started means that you and your employees, will be well-prepared, and have your plan implemented well in advance. From all of us at idBUSINESS, we appreciate the commitment and hard work you have put into making Red Flag Rules compliance a part of your business. We also thank you for choosing idBUSINESS to help you reach that objective, and look forward to providing you with more solutions that make information security a competitive advantage. In the meantime, if you have any questions about the Red Flag Rules or the FTC announcement, please contact your idBUSINESS Sales Representative.
The idBUSINESS Red Flag Compliance Module lets healthcare companies meet the requirements of the Red Flag Rules that amend the FACT Act of 2003. The legislation calls upon businesses with credit-based customer relationships to have a written identity theft mitigation policy. In spite of the fact that the Red Flag Rules specifically target healthcare providers, a difficult economic climate and wariness brought on by 10 years of HIPAA compliance, have led some healthcare providers to question the Red Flag Rules and the need for compliance. Those questions have been answered by a recent white paper from the World Privacy Forum that not only addressed the need for inclusion of healthcare in the Red Flag Rules, but called upon healthcare providers to use their compliance program as a fundamental aspect of patient care. According to idBUSINESS Director of Information Security Bryan Thornton, “Compliance may be the trigger that starts the process, but it should never be the end result. There are a lot of small practices out there who spent a lot on HIPAA compliance and have watched their policy sit on a shelf. While the Red Flag Compliance Module gives you the policy you need for compliance, it also gives you an actionable plan to strengthen patient relationships by demonstrating you value their information.” The Red Flag Compliance Module is unique to the marketplace for two key reasons. First, it is built on real-world forensic field experience. Second, it includes up to ten identity theft recovery policies for individual employees. Together, these benefits increase integration and utilization of a Red Flag-compliant policy, improving business performance while mitigating risk. The Red Flag Compliance Module is built on Thornton’s field experience with forensics firm Net Reaction, performing proactive information security planning as well as reactive data breach response. As a result, the Module includes 37 potential Red Flags - the 26 outlined by the legislation, plus 11 additional Red Flags to help firms satisfy the law’s requirement to add Red Flags based on prior experience. The idBUSINESS Compliance Module also includes an employee benefit, bundling up to 10 individual identity theft recovery plans into every subscription. The policies are managed by ID Experts, specialists in fully-managed identity recovery with over 3 million customers nationwide. While this benefit is geared to the individual employee, the entire practice sees a positive result. Says Thornton, “The aim of the Red Flag Rules is to eliminate the triggers that signal identity theft. The Compliance Module makes that security process part of every employee’s job function. Including individual policies is more than a great benefit - it’s an invaluable tool to underscore the value of information security to employees.” The idBUSINESS Red Flag Compliance Module costs $495, a price that falls below other compliance tools that do not include individual identity theft policies.
The US government is stepping up requirements for US banks to identify and prevent fraud related to consumer identity theft. In November 2007, Federal regulators issued a rule entitled "Identity Theft Red Flags and Address Discrepancies Under the Fair and Accurate Transactions Act of 2003," as directed by Sections 114 and 315 of the Fair and Accurate Credit Transactions (FACT) Act. With the November 1, 2008 compliance deadline looming, new research from TowerGroup finds that many US banks have mistakenly considered compliance with the "Red Flags Rules," as they are known, merely an administrative exercise - and as a result, most will need to take rapid action to meet the more stringent regulatory demands.

The idBUSINESS Red Flag Compliance Module can help insurance companies meet the requirements of the FACT Act’s “Red Flag Rules” prior to the November 1 deadline. “Red Flag compliance is especially important for the independent insurance company,” said idBUSINESS Director of Information Security Bryan Thornton. “The industry is struggling to find new revenue amidst increased regulation and a tough economy. Our Red Flag Compliance Module gives you the policy you need with only about half a day of work. Where it differs is in how it can engage employees and customers to grow the bottom line.” idBUSINESS lets agents connect compliance and customer service in three fundamental ways. First, the Red Flag Compliance Module is built on real-world forensic field experience from Thornton’s forensics firm, Net Reaction. As a result, the Module includes 37 potential Red Flags - the 26 outlined by the legislation, plus 11 additional Red Flags that have arisen during forensic work with real companies and their customers. Second, idBUSINESS provides Red Flag-compliant companies signage, window stickers, and web site buttons, all stating a commitment to protecting customer data. A recent Ponemon Institute study showed that 77% of consumers are “concerned” or “very concerned” about the potential loss of their personal information by a business. In this new marketplace, a dealership that communicates a strong security policy immediately gains a competitive advantage. Lastly, the idBUSINESS Compliance Module bundles up to 10 individual identity theft recovery plans with every subscription. The policies are managed by ID Experts, specialists in fully-managed identity recovery with over 3 million customers nationwide. The benefit can either be utilized as an employee benefit, or provided to key customers during the financing process. In addition, idBUSINESS offers opportunities to resell both personal and business products, opening a new revenue stream with perfect synergy to an existing insurance portfolio. Says Thornton, “The aim of the Red Flag Rules is to address the triggers that signal identity theft. The Compliance Module makes that security process an integrated part of the organization - crossing departments, job functions, and ultimately impacting customers in a positive way. When you're in the peace-of-mind business, that value can't be understated.” If you are ready to get started, click here to return to idBUSINESS.
